Liability for borrowed items

Questioner

LS, I lent a pair of binoculars to a family member who was going on vacation. The binoculars were stolen from the hotel room where he was staying. Is he legally obliged to compensate me for the damage (current value)? Is he liable? Kind regards,

Lawyer

In principle, yes. The family member must return the binoculars to you. Now that this is no longer possible, he must reimburse the equivalent value (current value). He may be insured for damage against theft and can claim this from the insurer.
