Claiming personal injury compensation?

I ended up in the WIA due to a bicycle accident (not work related) in August 2015. My now ex-employer has taken out an accident insurance that is valid for both business and private. I have done the entire settlement together with this insurance company. Personal injury damages and damage to my bicycle (private property) are paid out. Since I came into conflict with this employer during track 1 & 2 situation, the employer will not pay the insured amount to me. The employer took out the insurance himself and can decide for himself when he gives the payment to me. Since it concerns a large amount for both damages and the fact that I am in the WIA I think I am entitled to this benefit. What rights and obligations do I have? Can I claim this insurance benefit?Lawyer
Personal injury is personal and may not be withheld or offset by the employer. Or the employer must tax this benefit as wages.Lawyer
You can inform your former employer in writing that you want to claim compensation for the injuries sustained as a result of the accident. This has not yet expired. If the employer refuses, you can contact them directly if you wish.Questioner
