Free legal advice in case of illness and work

Questioner

Dear Sir/Madam, I called in sick at work. I work at a residential facility for the disabled, in Apeldoorn. I have complaints that are close to burnout. I feel no energy and concentration to be able to work. I am very tired. Now my manager does not allow me to go on sick leave 100%. I am now 50% on sick leave, the other 50% I have to hand in PBL hours. While I wanted to report myself 100% sick. They indicate that I first have to use up PBL hours, to get back into energy balance. I think this is just being sick. Are they allowed to use my PBL hours for this? I look forward to hearing from you. Yours sincerely,

You can and may report yourself 100% sick. Your employer or manager does not decide on this. If the employer doubts whether you are 100% sick, they can request an (emergency) check by the Occupational Health and Safety Service. The Occupational Health and Safety Service decides whether or not you are sick. The system of your employer/manager is therefore incorrect. If you have any further questions/problems, you should contact a specialized lawyer as soon as possible.
