You can always leave your old employer. Notice period or not. If you do not comply with the notice period, you may be liable for damages. The employer must go to court for this. He may not simply proceed to settlement. In the case of employment of less than 05 years, the statutory notice period is 1 pay period. Only in the case of employment of longer, it becomes 2 periods. If the employer has deviated from the statutory notice period, his notice period must be at least twice as long as yours (i.e. 4 periods). If not, the statutory period applies again.
