VVE Manager Fired? Discover Your Rights!
Questioner
I recently moved into an apartment with a VVE with 3 other homes. The manager of the VVE is external. This person refuses any form of communication and he does not want a meeting. I already indicated that it is mandatory to hold a meeting at least once a year. Isn't it true that you can only dismiss a management/board of a VVE during a meeting? Or could it be done in another way? If anyone has answers to the questions, I'd be very grateful. Thank you in advance.Lawyer
The meeting of owners can always – when it wants – dismiss the board or the chairman of the meeting. There must indeed be a meeting organized once a year, but for the dismissal it does not necessarily have to be on that day. The articles of association can provide more clarity about this. It is correct that the manager can be dismissed by the board or the owners (if there is no board) following a decision of the meeting to do so. If the manager refuses to convene the mandatory meetings, the owners can do so themselves under certain conditions or, if necessary, this can be enforced in court.
