Liability for Food Allergies | Legal Aid

Questioner

Good day, Recently I ate chicken with mixed peanut sauce at my company canteen. However, it was not mentioned in our canteen that the dish contained peanuts and therefore I had an allergic reaction. My question is who is liable and whether a canteen is not obliged to present the 14 food allergens if they are present in the dish served. Thank you in advance

Lawyer

If you know that you are allergic to 'peanuts' there is a form of self-blame, if you are going to eat a dish with 'peanut sauce'. Then it is up to you to ask if there are any harmful elements in the dish. Finally, as of December 13, 2014, every catering entrepreneur is required to inform consumers about allergens present in both packaged and unpackaged products if the guest requests this. In addition, all waiters are required to ask whether the customer has a food allergy. So you could address the canteen about the failure to do so.
