Liability of seller of home - Legal Aid
Questioner
Hi hi I bought a house and there are quite a few defects in the house. The selling party is and was aware of all the defects. When I made my purchase, neither the seller nor the real estate agent said anything about this. But I don't think the agent was aware of this. I've had the house for 1 year and 9 months now and I just found out a few days ago. Can I still hold the seller liable for the defects? Among other things, it is about... A swimming pool with a concrete edge of 125 cm high and 400 cm long and 300 cm wide. Those concrete walls were pushed under the paving and paved over it. 2nd is the meter cupboard that is not in order because the seller himself has been messing with the meter cupboard and later had a 'man' seal it again. In addition, partly the electricity that has not been installed properly.Lawyer
You can still sue the seller. However, if you claim that the seller knew about the defects (so they are not hidden defects for the seller), you will have to be able to demonstrate that the seller was aware of the defects. Furthermore, a defect in the electrical installation is a defect for which you can also hold the seller liable even if he was not aware of it, unless such defects are expressly excluded in the purchase agreement. Give the seller written notice of default and give him a period within which the matter must be resolved satisfactorily.Neem de volgende stap
