What are the consequences of a breakthrough between VVE's?
Questioner
Good evening, We own a terraced house, consisting of an apartment on the ground floor and the first floor. Together with my upstairs neighbor (the second and third floors) we form a VVE. For now, VVE 1. Recently we bought the ground floor (a garage/storage) of the building to the left of us. The garage has the same length/depth as our ground floor. This is also part of a VVE. For now VVE 2. Now we want to make a breakthrough to connect these. The permit for this has already been granted by the municipality. However, the municipality wants us to merge it. So the purchased garage/storage with our existing home. I have already spoken to someone from WOZ at the municipality. He also indicated that a new object demarcation has been made and the WOZ of the existing home will increase. On the other hand, I will not be assessed twice. The question now is what the consequences are. Here are a few questions: - does this have consequences for the VVE's? For example, because the surface area of 1 of the homes becomes larger due to the merger, of VVE 1? And therefore the ratio changes? Or is that not an issue because there is no cadastral merger? - depending on the above: does this mean that the deed of division of VVE 1 and VVE 2 must be amended? Hopefully not. - I assume that the municipality will cancel the house number of the garage/storage. Does this automatically mean that I can no longer get electricity, gas or water there? This is now being supplied. My wish is that I keep separate connections and that no adjustments are necessary in the VVE's dance division deed. Your advice is greatly appreciated! Thank you very much and regards.Lawyer
Adjustment of division deeds is not necessary if the destination of the purchased space is already storage/garage. Permission from both VvE's is required to make the breakthrough. If the garage no longer has a house number, the connection for utilities will probably disappear there, you will then have to pull the pipes from your home yourself.Neem de volgende stap
