Liability for personal injury: What to do?

Questioner

Last week a company wanted to install solar panels at my place. The roof was frozen and slippery and an employee slipped off the roof (fortunately no injuries). Fall protection was not used (according to the employee this was difficult because of windows). Next week they will try again and then too the weather forecast is that it could freeze (and the pans will be frozen). Now someone said that if something had happened I as the client would be liable for an injury. Is that correct?

Lawyer

That is not entirely correct. Only if work is carried out in the context of the client's profession or business can he be held liable. In addition, the fact that the contractor must be careful during the work and must weigh up the risks himself is also taken into account. After all, the company will have gained experience with working in difficult weather conditions. In principle, you are therefore not liable for any injuries to employees.
