Employer's liability for lost coat
Questioner
Before work I hung my coat myself in our own guarded cloakroom of my work, I did not take a receipt for this. This cloakroom has always been guarded during work hours, where the rest of the guests did get a receipt for their own things. Final score: coat gone. (Cloakroom) employee gave my coat to someone to whom it does not belong. Can I hold my employer liable for this? Something along the lines of safekeeping or employer responsibility for items during working hours?Lawyer
You have deposited your coat and may therefore assume that your coat will be handled with care during a guarded cloakroom. If there is damage, the cloakroom owner (your employer in this case) is liable for this damage and must compensate for the coat. Incidentally, in employer-employee relationships, the employer is often liable for theft due to breach of duty of care.Neem de volgende stap
