Agreements and commissions: tailor-made advice

Questioner

When we as a consultancy firm make agreements with partners about commission, what kind of agreement do we need? The procedure is as follows: We advise a company about one of our partners > Our partner contacts the company we advised > the partner sells his/her product or service to the company > We receive commission on the sold service or product > Process is repeated at different companies we have contact with. I come across several agreements, but I don't know which one we need now.

You cannot simply get an agreement for this from the internet, but a custom agreement must be drawn up in which the working method is laid down, as well as the amount of the commission and the payment dates. Agreements must also be made on how to deal with cancellations, complaints and liability claims. This agreement must be in line with your own general terms and conditions and should preferably contain a provision stating that the agreement prevails over the general terms and conditions of the client.
