Assistance with contract termination | Rechtswinkel.nl

Questioner

As a sole proprietorship I have entered into an agreement with a company that installs mileage registration boxes in cars. They would install a box in my car, including a subscription for 60 months. After 2 missed planning appointments and an installation appointment where the installer did not show up (took Saturday off) I want to get out of the contract, because I have no confidence at all in a good cooperation for the next 60 months. However, the company refuses to terminate the contract. I have already indicated 2 weeks ago, and several times since then, also in writing (by e-mail), that I do not want any further cooperation. Can I get out of this contract?

Lawyer

You cannot simply 'get out' of a contract, but you can when you do so because of the other party's failure. Failure to comply with the agreements could be a reason for you to terminate the agreement.

Questioner

First of all, thanks for the response. But what to do when the company responds by stating that they cannot terminate the contract? For example, can I force them to send me a confirmation of contract termination?

Lawyer

Not the supplier, but you are going to terminate. You can send them a registered letter in which you make your objections to the course of events known and in which you terminate the agreement due to the repeated failure to comply with the agreements.
