Rights in case of incomplete delivery - Legal aid centre

Questioner

On 23/06/17 I ordered kitchen equipment online from a catering supplier in the webshop. However, of the total order only one of the 4 products was delivered. The other items are missing. The supplier claims to have sent all items with GLS. After contacting me I received a shipping confirmation by email. This shipping confirmation, signed for receipt by the doorman of the building where I am established as a self-employed person, confirms the delivery of one product. This package weighed max. 1.6 kilos. There is still a package missing of 60 kilos. The GLS delivery person reported that GLS is not a freight carrier and never transports packages of this weight. Despite dozens of promises that it will be looked into urgently. In an email I sent last month, I indicated that I wanted to be contacted within 3 weeks about a solution, or my money back. That term has now been exceeded by far. Now I can send a notice of default, but what are my rights as a B to B customer?

You are of course entitled to delivery of the products and if the supplier does not meet his obligations, you could terminate the agreement, in which case you are entitled to a refund of the purchase price. What to do with the article that was delivered depends on the circumstances. If desired, I can help you further with this. In that case, please contact me immediately?
