Legal advice for stolen products

Questioner

After purchasing my product, it turns out that the product was stolen. Now the rightful owner is demanding his product back, which is logical. Is there anything I can do about this? Or am I just losing money? If there is anything I can do about this, please let me know!

Lawyer

If you bought the product in a physical or online store (not auction?), then the rightful owner can no longer reclaim his ownership. If you bought the product from a private individual and the rightful owner comes to claim it within three years after theft; then you have a claim on the seller of this product due to non-conformity because the fact that the product was stolen is a defect.

Questioner

I bought the product from a private individual. And if I want to claim against the seller, On which article of law is the non-conformity based?

Lawyer

Yes. Article 7:17BW 18 19 20 21, and also error applies article 6:228 section 1 and 3 BW. You may therefore dissolve or annul the purchase and you are entitled to the purchase price. You do not have to return the product because it must go to the rightful owner.
