Contractor liability in case of leakage

Questioner

In 2005 we bought a new-build home. In the past 12 years there was always leakage through the roof. This was repaired by the contractor. Now after 12 years we are suffering from a rotting roof and still have leakage. The contractor states that he is no longer liable, since the 10-year guarantee has expired. Can we hold the contractor liable for a serious defect, whereby the bonding of the building is affected?

Lawyer

That is indeed possible. Even after the guarantee, you can hold the contractor liable if the leak is related to the faulty repair. This is also possible with regard to the rotting roof. Collect as much evidence as possible and send a registered letter to the contractor. For help, you can contact me free of charge and directly if desired.
