Dear Sir/Madam, I recently appealed a WOZ decision from the municipality. The municipality in question had made a final decision on my objection without hearing me. The hearing still took place after this final decision had been made. Because the municipality did not respond, I appealed this 'final decision'. However, this week they came up with a new decision, in which the WOZ value was determined much lower. What should I do now? Can I still include this letter in the file? And what happens to the court fees if I withdraw the appeal?

If you withdraw the appeal because the municipality has accommodated you, you can inform the court that you are withdrawing the appeal for that reason. In the same letter, you must request a cost order from the municipality. The judge will order the municipality to pay the costs (including the court fee) if it is indeed the case that the municipality has accommodated you. This is stated in article 8:75a of the General Administrative Law Act.
