Last weekend during a festival I rented a locker (€9,-) from a company to store my valuables in during the party. We received a card with the locker and the code that went with it. After taking a picture of the card we tore it up into small pieces and threw it away. At the end of the party and as we were walking back I discovered that several items had been stolen. My iPhone 6s, credit card, health insurance card, driver's license, Samsung S8 charger, cigarettes, Ray Ban sunglasses and a jacket from one of my friends. I reported it yesterday and informed the insurance company. What steps can I take towards the organization of the festival or towards the locker rental company? I sent them a message via Facebook and their website, but have not received a response yet. I am curious about a response.Lawyer
Liability for theft from lockers is often excluded, but this must be clearly indicated with signs. If the latter is missing, the organization or rental company can be held liable if there is no supervision or it is clear that the theft could have been noticed with supervision. Please also consult the general terms and conditions. I advise you to hold them liable in writing by registered mail.Lawyer
The signs have no function: if a service provider offers you a (mandatory) locker, they are obliged to take good care of the items stored therein. Apparently they cannot do that and so you (or a lawyer for you) can hold them liable for the damage. That is the current value of the stolen items.
