Legal representative for your child?

Questioner

I am willing and able to work abroad. Sometimes I am difficult to reach there. A son was born from my previous relationship and due to circumstances his situation with his mother is turbulent. I have recognized my son and have joint parental authority. Is it possible to appoint a legal representative who can protect his interests in case of emergency if I cannot be reached?

Lawyer

If there are two parents with authority, it is not possible to appoint someone else who can also make decisions about authority in addition to both of you. Incidentally, your authority is suspended in principle if you are abroad because you are often difficult to reach by definition. You could try to make agreements about this with your ex. Depending on how turbulent or worrying the situation is with your ex, there could also be a supervision order at some point. In that case, the appointed youth protection officer can make decisions in certain cases, but not on all points. For example, the permission of the parents with authority is required for medical treatment.
