Dismissal during illness? Important information and advice

Questioner

Dear, I am currently at home due to burnout. The company doctor has advised me to resign, as he expects that the situation at my work will not change. The bad situation is partly the cause of my condition. I started as a temporary worker and have been a permanent employee of my employer for almost 10 years now. The company doctor mentioned a termination agreement in which I am entitled to a transition payment in addition to the right to unemployment benefits. Is this correct and if so, how high is the payment in my case?

First of all, you should act carefully when resigning during illness. There may be risks involved. In principle, there is no transition payment (TV) if you resign yourself, but this can be negotiated. To determine the amount of the TV, your income, age, and years of service are required. You can find calculation tools for this on the internet. You may also contact me directly and without obligation if you wish.

In case of a settlement agreement (VSO) during illness, you will not receive ZW benefits. The UWV will then take a detrimental action. Dismissal during illness is therefore only possible in very rare cases. Should you report yourself better, then you must apply. When you are ill, that is very difficult. If you then fall out again due to illness -> see above. I advise you to contact a specialized lawyer as soon as possible.
