The municipality wants us to demolish an existing house in connection with the extension of the house. Our gardener says make a pergola of it. Remove walls and roof and max. height of 250 cm and leave it in the same place. The municipality takes the position that this is not allowed.... Our question is whether that is justified?

The municipality should refer to the underlying rule of their argument; perhaps it would have been wiser to demolish and then apply for a permit for the pergola or report it. Check the zoning plan to see what is and is not allowed and the aesthetic plan if available.
