Legal Question about Employer's Declaration?
Questioner
Dear Legal Aid Clinic, I have emailed an employer's declaration to a rental company. The rental company has contacted my employer regarding incorrect information in the declaration. My employer has provided the correct information. After this, I have been informed by my employer. Can the recipient of an employer's statement contact my employer with questions about the statement without my knowledge? And is my employer allowed to provide that information without my knowledge? My employer indicates that it is customary for a recipient of the statement to contact the employer and request information. I wonder what privacy legislation says about this. I have provided documents but have not signed a statement or anything. Thanks in advance for your effort.Lawyer
Provision must not be incompatible with the purpose for which the employer collected the data. Why did the rental company contact your employer? If you wish, you can contact us without any obligation.Questioner
My date of birth was incorrect, this was checked. Now, it is not so much about what was asked, but about the fact that I am not informed about this. It would be nice if I was first informed by the landlord that he wanted to call my employer (or give me the choice to arrange this myself). And when my employer subsequently checked with me whether it was correct that the landlord should have my employer's statement. Apart from 'neat', I am curious about how this is arranged according to privacy regulations. My employer's response that it is 'customary' says nothing about this.Lawyer
Your employer must have taken measures to prevent the data from being disclosed further before he is allowed to transfer the personal data. If you wish, you can contact us without any obligation.Neem de volgende stap
