Want to claim back your shipping costs? Get free advice!

Questioner

After cancelling a remote purchase (by telephone), the supplier no longer wants to refund me the delivery costs (€95). The supplier has arranged for the product to be collected again in consultation with me. Here we have an agreement that this would also be done for 95 euros. I will bear these costs. Now I am claiming the shipping costs back, but the supplier says I should be happy that they collected the product, otherwise it would have cost me a lot more money to send it back myself. Several emails have been sent and telephone conversations have been made (recorded) regarding this dispute. I have confronted the supplier with the fact that in my opinion, Civil Code 6, article 230r paragraph 1 and 230s paragraph 6 are being violated. There is, however, little progress being made. What is my best option in this case? Suppose I were to proceed with a summons, what are the chances that the legal costs would be reimbursed to me?

Lawyer

If the seller has not informed you about the refund of the shipping costs when returning the product, the seller must bear these costs himself. If a notice of default has no result, a collection procedure can be started in which I can assist you free of charge. Usually, payment is then made, so that it does not have to come to a summons in which you have a good chance of being reimbursed for a large part of the legal costs. It seems that you are not being taken seriously. A lawyer can often get the case moving. If desired, please contact me directly and without obligation for assistance.
