Questioner
my wife has a bv. now she wants to take a credit on the business account. the company consists of rented space. now my wife is as dga together with her brother. He has a rental house and we have a house that we own in both the names of my wife and me. What happens to the debt in case of bankruptcy? Will this be charged to our house or not?Lawyer
In principle, you are not personally liable for the debts of the BV. The credit provider will probably ask your wife's brother to co-sign for the credit of the BV. In that case, the debt to the credit provider can be collected privately and then you, with your own home, are probably the first to be looked at.Questioner
thank you for your response. so your advice is better not to take out any credit. I do not want to be held personally liable in the event of bankruptcy.Neem de volgende stap
