Legal questions about abandoned furniture

Questioner

Dear, I have a question regarding items left behind in a purchased home. During the last inspection before the deed was signed, several pieces of furniture appeared to have been left behind. We did not mind this, as we still wanted to purchase the items in question. Now, more than a week after the deed was signed, the seller asks for one of these items. Are the items their property and do we have to return them, or was this transferred to us when the deed was signed?

Lawyer

The items have not become your property and you will have to hand them over. However, the seller does not have the right to leave them there or pick them up at will. He should have delivered the house empty (except for items that were taken over). My advice to you is to let the seller know that he can pick everything up within a week and that otherwise you will put it on Marktplaats (whether that is possible is still the question).

Questioner

Thanks for the response. We have no problem with it and would like to keep the items that were left behind. My question was more whether they can still come back to the items that they left behind after the transfer. So about which we did not include anything in the agreement.
