Right to Performance Bonus: Your Legal Questions Answered

Questioner

My employer recently started a performance bonus. One of the criteria of this bonus is that the invoices on which the bonus is calculated have actually been paid. However, in my department, due to regulations, a different payment term is used. As a result, the turnover, at the time the bonus is calculated, is exactly €0. Complaint to management results in a 'too bad, we'll include it in the evaluation'. Of course, the employer is free to set up the scheme as he wishes, but is an unreasonable rule like this allowed there?

Lawyer

A performance bonus should be reasonable. It is not reasonable to reward differently. For example, management could change the deadline of the premium bonus. If you wish, you can contact us without any obligation.

If you are entitled to the performance bonus and it is earned in a certain period, you should be rewarded for this period. The fact that a different payment term is used in the department due to regulations does not matter. You can file a complaint about this.
