Cancel your car purchase - Legal advice

Questioner

Hello, last week I bought a car (used) from a BOVAG affiliated garage. There were already some things during the test drive, but they were supposed to be fixed. I pick up the car and drive away after paying. Now I discover that the problem has not been fixed. I also discover heavy rust at the doors. And I bring the car back immediately. I am assured that this can be fixed by an approved damage company. (The first problem is supposed to have been solved) Then I am first told that it will take a bit longer than expected. Eventually it is decided to replace the doors. Is it still possible to reverse the purchase? Ultimately, it is about defects that were not reported. The garage still has a duty to report. Thank you for your advice.

You want to cancel the purchase. This is possible if there is a shortcoming. The company seems to have acknowledged this by wanting to repair it. This opportunity for repair must first be offered to the garage company by means of a notice of default with a term for repair. Only if this does not produce any results, then default occurs and the purchase can be canceled. If it turns out that all problems have indeed been resolved, cancellation becomes difficult. If the problems have not been resolved, this offers new opportunities.
