VSO Advice on Dismissal: Is it a Good Deal?

Questioner

I have been declared redundant due to business economic reasons. My employer then submitted a resignation request via UWV but they made a negative decision. Now my employer has offered a VSO with of course a transition payment but also about 2 months' salary. I have been employed for 8 years. Is this a good deal? Should I not accept it? Should I wait for a subdistrict court judge? Who can give me good advice? Thanks in advance.

Apparently the employer wants to end the employment contract good to good. A VSO is possible, if you want that too. This means that the employment contract is terminated on neutral grounds. Usually, the UWV will agree to a VSO and you will retain the right to unemployment benefits. However, now that UWV has decided negatively, the VSO must be legally very well sealed and a fair compensation must be paid. Even then, there is some risk. You are the one who decides on that. It also plays a role whether you can easily find other work.

There are many things you need to consider when dismissing via a settlement agreement. The employer submits a dismissal to the UWV if you have been dismissed for economic reasons. If I understand you correctly, the UWV has rejected the dismissal application in this case. This means that you have a good negotiating position. Whether this offer is a good deal depends on many circumstances. The settlement agreement must be drawn up in such a way that you are entitled to unemployment benefits after signing it. It is therefore important to have the agreement checked by a lawyer.
