Help with legal issues: liability and brokers
Questioner
In 2015 we gave an agent an assignment to sell our company (rental property) with residential property (ownership). The rental property (Guesthouse) turned out to be full of open asbestos of the most sickening kind. The company was closed, there was nothing to sell. The owner was a friend of the agent. He never admitted guilt, and this man wanted us to pay the agent. The agent never informed the party that wanted to buy about the asbestos. Silenced. We had to fight on our own strength, because the landlord (wealthy party) had friends everywhere, including the Rabobank. He did buy us out. The question: Who pays the agent? The judge has ruled that we signed the assignment ourselves, no further mention of asbestos. I cannot accept this. In my opinion, the law says completely different things about liability and asbestos. We rented that property for eight years, worked in it, but with us hundreds of guests (Guesthouse). The landlord still gets away with it. Still I hope someone has the courage to bring this matter to light. We are currently in Spain, to process everything in peace.Lawyer
Has the property been sold by the estate agent? Do I understand correctly that the business premises were your property but that it was rented out?Neem de volgende stap
