Sickness benefit in case of incapacity for work – Discover your rights

Questioner

I work for a healthcare institution, both as a permanent job and as an employee of their own flex agency. I have been disabled since September 2nd due to a bicycle accident abroad. And am still recovering. I also worked at the flex agency. The 3 months prior to the accident I worked through the flex agency, receipts: June - 498.16, July - 691.82, August 596.34 euros. I understand 'now' that I should have received a sickness allowance from the flex agency. I was not aware of this and therefore did not report myself sick to them. Am I still entitled to sickness benefits despite the fact that I am still sick? An email was sent by the night shifts to the flex agency in October 2016, which contained the following text: This morning Johan indicated that he would not be available for night shifts until the end of December. Johan Berends' night shifts have been removed from aysist as of today. I received a cc'tje of this mail. I would like an answer as to whether I can still claim the unpaid sickness benefits for almost a year?!

Yes, you are entitled to continued payment of wages, depending on the conditions, either 70% or 100% of the wages. I advise you to still make a written claim for this.

An employee who works under an employment contract can enforce retroactive payment of wages in the event of illness. You can therefore send a wage claim to the temporary employment agency. If you wish, you can contact us without any obligation.
