We want to buy an agricultural property. 2 weeks ago we went to the municipality to see if the destination could be changed to horse farm. During the conversation it came up that this was possible if we wanted to change it to productive horse farm. This corresponded with what we want and do. We breed horses, train them and eventually they are also sold. This would not be a problem, they said. Now I just got an email that it is not possible because this would be purely agricultural and no animals may be kept at all. I find this strange, especially because they themselves came up with the idea that productive husbandry falls under agriculture. Can we appeal this and if so, where should we go? It is a company that has been for sale for at least 3 years and has a total area of 2.03 hectares. Much too small to make a gardening company (which it is now) because the building block also only includes the house and barn. The surrounding lands that were included have already been sold.Lawyer
Yes, you can file an objection in time. The email can be seen as a decision against which an objection can be filed. If the objection is not honored, an appeal can be filed with the court. I am happy to help you file the objection. According to the General Administrative Law Act, the term for filing an objection is six weeks.Neem de volgende stap
