Reclaiming health care allowance: Legal advice

Good evening, On 3 December 2012, a question was asked about the withholding of health care allowance by the municipality when paying out social assistance benefits. I had the same experience and am now paying back 4000 euros, because they claim they were allowed to withhold this. How do I get this back, because the municipality is sticking to its guns? Care allowance is not income for the Participation Act. This income may therefore not be deducted from the benefit. If you want, I can help you with this.
