Legal Advice on Contract Extension
Questioner
I have a one-year contract that expired on July 1st. In mid-June I was told verbally that my contract would be converted into an indefinite period and with it a substantial pay rise. On July 1st I received the contract with the pay rise stated on it which I signed. I gave both copies to my employer because he still had to sign the contracts. Now on July 19th I am told that my contract will be converted into an indefinite period but that my pay rise is on hold for the time being due to the circumstances in which the organization finds itself. I have worked all those days. Do I understand correctly that my contract has now been tacitly extended and that I am entitled to a fine of 1 month's salary because the organization is not delivering on what was agreed? In addition, the organization wants to offer me the indefinite term contract at the end of this week without the salary increase to sign. My guess is that I better not sign it. Is this correct?Lawyer
You have been offered an offer that you have accepted. This has resulted in a new agreement, namely an employment contract for unpaid time at a higher salary. The question is whether you can prove this if it were to be in dispute. Have you retained a copy of the agreement that you signed? Indeed, it would not be wise to sign another agreement now without a pay rise, because that would then become the current agreement.Neem de volgende stap
