Dismissal and Notice Period: Your Rights

Questioner

I will probably be partly fired for economic reasons, previously 1 year and 5 months ago I also lost hours, now I understand that for economic reasons this will probably be approved by the UWV, but then I will have lost 12 hours in another 6 months. I find this bizarre. What can I do best in such a situation, try to find another job before I end up on unemployment benefits, otherwise you will be left with a broken unemployment benefit. How much notice period should my employer keep, I have been employed for 16 years, only my contract was changed 1.5 years ago, on my pay slip it still says I was employed in 2000, so I would like to know whether that is 1 month or 3 months

You have worked continuously for the same employer, the fact that you may have changed positions or worked more or fewer hours does not affect the notice period. For the correct notice period, you can look in the collective labor agreement. If nothing is stated there, the statutory term of 4 months applies (you have been employed for more than 15 years). This notice period must be observed by the employer, in connection with your unemployment rights. In any case, seek advice from a legal expert to see if the dismissal is all according to the rules. If necessary, you can still object to the UWV if the severance payment is issued. You may also be entitled to a transition payment, but that depends on a number of situations.
