We rent a house to two students. The window was smashed in one night. Who is now responsible for the damage? We have this stated in the rental agreement. 2. Conditions This agreement obliges the parties to comply with the provisions of the law regarding the letting and renting of residential space, insofar as this agreement does not deviate from them. This agreement includes the 'GENERAL PROVISIONS OF THE RENTAL AGREEMENT FOR RESIDENTIAL SPACE', established on 30 July 2003 and filed on 31 July 2003 with the registry of the court in The Hague and registered there under number 74/2003, hereinafter referred to as 'general provisions'. The general terms and conditions apply unless expressly deviated from in this agreement or unless their application with respect to the rented property is not possible.

In principle, the landlord is liable for the glass damage, unless the students caused this intentionally. The provisions in the rental agreement apply as a starting point. If nothing is determined regarding glass damage, the landlord is liable for the damage and can claim this on his building and/or contents insurance.
