Liability of Monumental Trees - Legal Aid

Questioner

In the backyard of our recently purchased house there are 2 monumental trees. These are also listed in the tree register. The trees date from around 1850 and are quite tall. According to the tree foundation, we are not allowed to carry out any pruning work, etc. But this must be done by a specialist. Since we live in the center of a village and therefore have to deal with neighbors, we are actually very curious as to who is liable for any damage caused by these trees? One of the trees is also against the property boundary. Could this still pose a problem?

Lawyer

The owner of the land on which the trees stand is liable for any damage caused by lack of maintenance.

Lawyer

Property boundary trees that have been standing for more than 20 years may not be removed (prescription plays a role)
