Liability for renting a camper - Legal advice centre
Questioner
I had damage to a rental camper due to the height of the camper. However, at this particular entrance to the parking lot, all height warnings had been ---temporarily---- removed. The security manager confirmed that they were there before and also showed how there were warnings at the other entrances. I have his details and it is also in the police report. The low gray bar completely disappeared against the gray background. I have pictures of everything. The air conditioning on the roof and 2 roof hatches had to be replaced. Damage: 2400 euros (unreasonable amount by the way but that's another story) The damage was at the Bay West mall in Port Elizabeth, South Africa. Due to the failure to provide any form of height warning, I would like to recover damages from Bay West Mall. I would like to hear how you can help me with this.Lawyer
Bay West mall must be held liable in writing for the failure to warn road users (for the lack of traffic signs) as a result of which you suffered damage. You have photos of the situation and the police report to support this. Please note that if Bay West does not admit liability, it will be difficult to start legal proceedings. After all, South African law applies.Neem de volgende stap
