Good morning, On the morning of March 16, I called my manager in sick. On the evening of March 17, I sent my manager a message that I was still sick and would therefore not be coming to work this weekend. Then I get a message back asking what I have. On March 20, after visiting the doctor, I informed the manager of my illness and that I should report when I feel better again. On the evening of March 24th he left a message saying he wanted to speak to me in the store on March 27th. In an email on March 28, I indicated that this is not possible due to my illness and that I would like to make an appointment with him when I have recovered. Now yesterday, April 3, I received a message from the head office that my sick leave notification of March 17 was not accepted and that they would deduct the days that I was absent from my leave balance. - Can an employer indicate more than 2.5 weeks after a sick leave report that they will not accept it? - What steps should I now take towards the employer? Thank you in advance.Lawyer
After reporting sick, the employer must call in the Occupational Health and Safety Service. Not the employer, but the Occupational Health and Safety Service determines whether or not you are sick. You have been to the GP. He found you ill. The employer has violated the law. The employer must therefore pay for the sick days. Based on the law, he may charge 2 waiting days. He also only has to pay 70%. This is unless otherwise agreed or otherwise arranged in the collective labour agreement. If you have any further questions/problems, I advise you to contact a specialized employment law attorney as soon as possible,Neem de volgende stap
