Sick leave rule: What are your rights?

Questioner

Dear Madam / Sir, I work for a large company. Now a new rule has been devised regarding reporting sick, namely: If an employee reports sick and is still sick after three days, he/she must physically report to the team coach on the fourth day for a meeting. Can a company simply implement this rule? There is nothing about this in the CAO. I read the following text there: 'employee stays home for the first ten calendar days after reporting sick to enable a possible check on behalf of the employer'. By the way, it seems very likely that this rule only applies to production employees and not to the entire company. Please respond.

That is a very special rule. How is one supposed to comply with it in the case of physical incapacity? In my opinion, this rule cannot stand the test of criticism. Perhaps the employee representation can object to this.

The Works Council has the right to approve (changes to) the absenteeism policy. It is not the employer who determines whether you are ill, but the ArboDi4enst. The ArboDi4enst also determines whether or not you are able to report to the company. I would therefore also involve the Works Council and the trade union (FNV).
