Legal Advice in case of Conflict with Employer

It concerns a 1 time conflict with employer. Sent home after the conflict so that both could think. In the conversation that followed, we received three options from the employer. 1. Employer starts dismissal procedure 2. Dismissal by mutual consent 3. Reintegration through external agency. I have been redeployed internally due to back problems that have been going well for three years. I do not agree with the options and propose a conflict management conversation with a confidential counselor or mediator. The employer does not respond to this and continues to insist on the three options. There is nothing incriminating towards me in my personnel file. I am also still working and have not missed a day since the conflict (except for a cooling-off day). I would like advice on what is best for me now.Lawyer
First of all, you can think of (continuing to) offer the usual work to secure continued payment of wages as much as possible. If the employer does not (any longer) respond to this, then they - independently of you - will choose option 1. How great the chance of termination is, is difficult to say. But in general, a single incident will have to be very important to be enough for a forced termination. For option 2 they need you. At this point I cannot judge what your file is worth. I can well imagine that the employer will make you a concrete proposal. I advise you to contact a dismissal lawyer. Your proposal to the employer seems sensible to me at the moment, although the essential difference between a mediator and reintegration through an external agency is not entirely clear to me when they are both aimed at continuing the employment relationship.Neem de volgende stap
