What to do when a job is offered? Free legal advice!

Questioner

Due to new corporate structure, I have been offered a completely different job. It concerns the change from a management position in sales to an offer to become a tender specialist within a team. The reason for this is that my current team is being merged with another team and there is therefore 1 manager left, as far as I know. I do not want to accept the job, but would like to know if I can receive compensation (if so, how much with a permanent contract and 2 years of service, 37 years old) and whether I am entitled to unemployment benefits with an employment history from 1998? I look forward to hearing from you.

The assessment of whether you can receive compensation (due to termination of employment) depends on how the parties have behaved during the reorganization and what agreements have been made about this with, for example, employee participation or trade unions. An organization has the right to change its structure. They will have to give the employee who is affected another place (functional or location) in the organization as best as possible. The concept of suitable offer is very important in this. The concept of suitable is determined by many circumstances that you do not all describe in your question. If there is no match, for example because you do not want the position, your employer will eventually seek to terminate the employment relationship. If she feels that she has made you a suitable offer, she will - in general - be less willing to pay you compensation. If the UWV decides the same at a later stage, you may even run risks with regard to your unemployment benefit. You will therefore have to ask yourself carefully whether it is reasonable to expect you to accept this position. If you have any further questions, please contact one of our affiliated lawyers.
