Legal tips for child shoplifting

Questioner

My 11 year old son stole something from the store. He now gets a total fine of €270 (€89 of the goods and €181 of shoplifting fine). Now I have a few questions. I wonder if that will be registered because he is under 12 years old. Does that also result in the VOG later? Does he have to do HALT punishment? Do I have to pay the fine in full? Is there a way not to pay the fine because that is not possible for me at the moment. Thank you very much.

Lawyer

Children under the age of 12 cannot be prosecuted. I would therefore say that the fine for shoplifting should not be imposed. You as a parent are liable for your son and must compensate for the damage caused by your son. Perhaps you can claim on your third-party insurance in this regard? Halt is only an option if the Public Prosecution Service so determines and for young people between the ages of 12 and 18.
