Hello, Recently, a new VVE was appointed by our flat. They are not doing so badly, but on one point we differ greatly in opinion. We have block heating. Recently a new (modern) central heating boiler was installed with a sensor outside. That sensor ensures that the boiler does not burn when it is warm outside. It also ensures that it burns lightly instead of at full blast in moderate weather. Sounds good you might say... but since it has become colder I have not been really warm. After many hours of firing at full blast it becomes 19 degrees. With luck the sun will shine, then it is party time! I also can't open the vents in the windows, because that causes extra cold. Airing is no longer so attractive, because it takes hours for it to warm up again. So I am not so happy. That is why I contacted the VVE of course. In an email they 'informed' me about the sensor. After two more emails from my side there was no reaction. So I do not really have the impression that they are trying to solve the problem. My question is whether a VVE is allowed to determine what is good for me in my living room? And can I use the law to ensure that they adjust/disable the sensor?Lawyer
You probably mean that there is a new board. The VvE already exists by law. The board is executive, the AGM (general members meeting) is the highest body. The board must of course take complaints seriously. If they do not do this, or you still cannot resolve it together, you can go to court, but you can also first submit this to the AGM. Agreed. Practically speaking, the most important thing is: find supporters! Is there a complaints regulation at this VVE? Definitely bring this point up at the ev Members Meeting. Tip: In a registered letter to the board (possibly mentioning the number of supporters) request an adjustment within a certain period.
