Questioner

My ex-partner and I have been separated for half a year and live separately. Which is already an unpleasant situation if you have children. We lived in an apartment that we rent privately, with an all-in rent of €732.56 all-in. My ex and 2 children continued to live in the old rental property, only the lease is still in my name. She has been registered all that time, and has been paying the rent for half a year. But she was never on the lease. Now I have asked the landlord to change the lease, or to make a new lease. Now the landlord only wants to make a new contract, which I don't find so bad. The landlord has now indicated that he wants to increase the all-in rent by €110 per month! Because we have supposedly been paying too little for service costs for 2 years, which I have never heard him talk about. We have block heating so we do pay a lot in service costs. I wouldn't know how much because this is not specified in the contract, and we don't get a bill for this either. What are our rights? and can the landlord increase the rent by so much? does the landlord have to make the costs public? and can my ex take over the contract? Thank you in advance.

If your ex-partner was a co-tenant, she could have continued the lease. The rent may not be increased in that case. A request for co-tenant can only be made if there is a joint household. In your case, that is no longer the case. There are some rulings that a request for co-tenant can still be made a few months after the relationship has ended. In order to be able to judge things better I need more information. You can contact me about this.
