Divorce with a guardian? Discover your rights!

Questioner

I am going through a divorce and we are 90% done with the divorce plan (incl. parenting plan). My ex-wife has been living elsewhere since August and has been assigned a home since mid-October. Now it turns out that my wife has a trustee who helps her with her finances. Can he now also influence the divorce plan and the financial division in it?

Lawyer

If there is a guardian appointed by the court, this guardian must indeed give permission for making financial arrangements (such as alimony). Due to the guardianship, the management of the goods under guardianship no longer falls to your wife. This means that she can only dispose of these goods with the cooperation of the guardian. If the guardian does not cooperate, your wife may be able to obtain permission from the subdistrict court judge.
