On September 16, 2016, a handyman repaired our chimney. There were leaks and the joints were no longer completely waterproof. A few weeks after the work, the chimney turned completely white. We immediately sent an email about this on November 6, 2016, with accompanying photos. After a lot of emailing back and forth, an appointment made to come by on November 23, 2016 was not kept, he finally came to take a look on Saturday morning, December 3, 2016. He drove to the Gamma, bought something there, smeared it on and it was supposed to be solved, but it wasn't.... After many more emails stating that the problem had not been resolved, we received the following excuses: he would contact the supplier and try it out on his own home, but it simply remained quiet again. Can we hold him liable in some way? We really have no confidence that he will solve this. The fact remains that the appearance of our more than 100 year old house is so disfigured by the now ugly, white-stained chimney.Lawyer
You can indeed hold him liable, stating in the letter that you will give him the last chance to repair within a reasonable period, if you wish, failing which you will either have the repair done elsewhere at his expense or partially cancel the purchase.
