Who is responsible for the wall? Free advice!
Questioner
The municipality owns an old walled nursery. The wall is about two meters high and in poor condition, it leans inwards. Our garden borders on about half a side of this wall. In our proof of ownership there is nothing about the wall and on the enclosed land registry drawing there is no wall only a plot boundary drawn. Are we co-owners of the wall and therefore responsible for the restoration costs of half of our share?Lawyer
This is possible if it is exactly on the property line.Lawyer
Either it will first have to be assessed whether or not the wall is partly on your land. If not, you do not have to contribute to the maintenance. If there is a dividing wall on the property boundary, maintenance will be the responsibility of both/joint owners. If the wall is (partly) entirely on your land, you may in principle decide for yourself what should be done (with that part): maintain it, do nothing with it or even remove it. Be a good neighbour and act as much as possible in/after consultation with the municipality.Neem de volgende stap
