Sick leave and wage withholding: What to do?

Questioner

A friend of mine had reported sick on July 1st but had not given a written explanation. Now this week his entire monthly salary is being withheld because of this incident. Is this allowed? This is an 18 year old who works part-time as a shelf stacker.

Lawyer

When reporting sick, you NEVER have to give the reason. The employer has NO right to medical information. You only have to give that to the occupational health physician. You only have to tell the employer how long you think you will be sick. If the employer does not trust it, he must arrange an (emergency) check by the occupational health service. The withholding of wages is therefore completely unjustified and the employee is entitled to continued payment of wages (at least 70% or the minimum youth wage).
