Liability for hidden defects
Questioner
We bought an apartment. After a VVE meeting we are informed that we have to have insulation installed under our laminate floor. Apparently the previous owner did not do this while the deed of division and model regulations require it. During the negotiation he/his sales agent did not indicate this. In this case can we hold the previous owner liable? As hidden defects?Lawyer
It seems that the previous owner knew this and should have informed you. Before you take action, it seems wise to investigate whether the previous owner has already been addressed by the VVE. That will make your position considerably stronger.Neem de volgende stap
