Hello, I had a consultation with a mortgage advisor on September 21, 2016. During this consultation I brought the annual accounts and income tax returns of the last 3 years. Based on this information, the mortgage advisor made a calculation. I was able to borrow €131,500 with 1.64% interest. Unfortunately, on October 5, 2016 I received a phone call from the mortgage advisor that the annual return of 2013 was incorrect. I checked this and it turned out that a balance sheet item had indeed been booked incorrectly. As a result, the balance of the profit and loss account and the balance of the fiscal profit calculation were not the same. I had this adjusted by my accountant. The confirmation of this was sent by email on October 12. On October 19, 2016 I received a phone call from the mortgage advisor that an error had been made in the mortgage calculation. The addition of my company car had not been calculated. Now I get less mortgage than was discussed during the consultation. I now only get a mortgage of 112,900. so a difference of €18,600. so €18,600 more of your own money must be invested than was calculated on September 21. The mortgage advisor did not look at my income tax returns at all, since the addition of my car would have been seen. As a result, incorrect advice was given. And I think that the mortgage advice is seriously inadequate. In the meantime, I have already filed a complaint with the mortgage advisor, but I would like to know what I can do about this legally. Is it possible to hold the mortgage advisor liable? since I now have to contribute money that was reserved for furniture, among other things, to the house. For what amount can I hold him liable? Is that just the advice costs or also the money that I now suddenly have to contribute myself?Lawyer
If the mortgage advice is seriously deficient and this has been established, you can hold the mortgage advisor liable for the damage you suffer and will suffer, e.g. for the extra personal money you mentioned. There must therefore be damage that was reasonably incurred.
