Liability for Destruction of Suitcases - Legal Aid

My ex-husband has delivered my 2 suitcases to an asbestos removal company to check them for asbestos. These suitcases were both not contaminated with asbestos, but were accidentally destroyed by one of the employees. I want to hold them liable, but they say that this is not possible because my ex-husband was the client. Only he can hold them liable or sign a waiver that he is renouncing the case. So that I can still hold them liable. Only there is no more contact with my ex-husband. What are my rights? And is there a law that protects me in this?
