Liability for Destruction of Suitcases - Legal Aid
Questioner
My ex-husband has delivered my 2 suitcases to an asbestos removal company to check them for asbestos. These suitcases were both not contaminated with asbestos, but were accidentally destroyed by one of the employees. I want to hold them liable, but they say that this is not possible because my ex-husband was the client. Only he can hold them liable or sign a waiver that he is renouncing the case. So that I can still hold them liable. Only there is no more contact with my ex-husband. What are my rights? And is there a law that protects me in this?Lawyer
You can also file a claim as a third party damage claimant. Since you are the owner of the suitcases. You can also request your ex-husband to issue a waiver. On the other hand, you do have the burden of proof that the suitcases are yours and were taken by your ex-husband. You can also hold your ex-husband liable. If you were still married at the time of the transfer of the suitcase, then you are both the principal. For further information, you may contact me directly if desired.Neem de volgende stap
